III.1.4) Objective rules and criteria for participation

Bidders should note that, at this stage, this notice only serves to obtain notes of interest in this opportunity. No evaluation or assessment will be undertaken at this time. An ESPD will be released to all those bidders who have confirmed interest by the closing date, and the statements in section VI.3 of this notice - Additional Information - will apply at that time.

III.2) Conditions related to the contract

III.2.1) Information about a particular profession

Execution of the service is reserved to a particular profession

Reference to the relevant law, regulation or administrative provision:

Service providers will be required to be registered with the Care Inspectorate and comply with all the relevant guidelines. Tenderers will be responsible for ensuring that they meet the latest requirements of the Care Inspectorate or as superseded.

All staff should be registered or in the process of registering with the Scottish Social Services Council (SSSC) at a level relating to their designated post as should they be qualified or undertaking training for such.

All staff must be members of the Protection of Vulnerable Groups Scheme.

Under Section 15 of the Immigration, Asylum and Nationality Act 2006 employers are liable to civil penalty if they employ someone who does not have permission to work in the UK.

Your company must confirm in writing that all workers supplied in the execution of this contract are legally entitled to work or provide services in the UK and that in the event that a person supplied by your agency is found not to be legally entitled that you will indemnify Robert Gordon University in full against an action taken by any authority and for all fines and expenses incurred accordingly

III.2.2) Contract performance conditions

The successful provider will be required to enter into a lease agreement with the University, for the Nursery buildings used. The initial annual rental valuation will be 95,000GBP per annum. This will be subject to an uplift by a percentage value based on the Retail Price Index every 2 years.

There may be a requirement to 'TUPE across' existing staff from the current services provider within the Nursery.

4A.1 - If required by the member state, bidders are required to be enrolled in the relevant professional or trade registers within the country in which they are established.

4B.2.1 - Bidders will be required to have a minimum yearly 'specific' turnover of 500,000GBP for the last 2 years in the business area covered by the contract

4B.3 - Where turnover information is not available for the time period requested, the bidder will be required to state the date which they were set up or started trading.

4B.4 - Bidders will be required to provide adequate assurance of financial strength to successfully complete their contractual obligations.

Bidders must provide their 3 most recent sets of annual audited accounts, including balance sheet and profit and loss information.

Bidders will be required to state the values for the following financial ratios:

Gearing Ratio, which should be calculated as follows:

Long term liabilities / capital employed x 100

A review of your ratios and audited accounts will be undertaken. In some cases the review may lead to an additional request for further financial information to help clarify any potential issues raised.

4B.5.1 - It is a requirement of this contract that bidders hold, or can commit to obtain prior to the commence of any subsequently awarded contract, the types and levels of insurance indicated below:

Employer’s (Compulsory) Liability Insurance = 5,000,000GBP

Public Liability Insurance = 5,000,000GBP

Professional Indemnity Insurance = 2,000,000GBP
