Section III: Legal, economic, financial and technical information

III.1) Conditions for participation

III.1.2) Economic and financial standing

List and brief description of selection criteria:

In accordance with Regulation 59(12), as this proposed Framework Agreement is divided into Lots, these Economic and Financial Standing selection criteria applies to all lots.


Minimum level(s) of standards required:

1. Employers' Liability Insurance - in accord with Regulation 5 of the Employer's Liability (Compulsory Insurance) Regulations 1998 (as amended) to a minimum indemnity level of 10 million GBP per occurrence

2. Public Liability Insurance - to a minimum indemnity limit of 10 GBP million per occurrence

3. Products Liability Insurance - to a minimum indemnity limit of 10 GBP million per occurrence or in the aggregate

4. Motor Vehicle Insurance - in accord with the provisions of the current Road Traffic Act 1988 (as amended) to a minimum indemnity level of 5 GBP million for property damage and unlimited cover for Third Party bodily injury

5. Relative to financial stability, Scotland Excel will conduct a financial analysis for each bidder based on reports from a credit reference agency such as Equifax or similar. Should Scotland Excel identify any degree of risk following analysis bidders may be required to produce such additional documentation as Scotland Excel requires to demonstrate financial stability. If such additional documentation can not be provided this will result in the tenderers bid being deemed as non-compliant.

III.1.3) Technical and professional ability

List and brief description of selection criteria:

In accordance with Regulation 59(12), as this proposed Framework Agreement is divided into Lots, these Technical and Professional Ability selection criteria applies to all lots.


Minimum level(s) of standards required:

Quality Management Procedures.

The Tenderer must hold a UKAS (or equivalent) accredited independent third party certificate of compliance to BS EN ISO 9001 (or equivalent),

OR

The Tenderer must have the following:

A documented policy regarding quality management. The policy must set out responsibilities for quality management demonstrating that the Tenderer has, and continues to implement, a quality management policy that is authorised by their Chief Executive, or equivalent, which is periodically reviewed at a senior management level. The policy must be relevant to the nature and scale of the work to be undertaken and set out responsibilities for quality management throughout the organisation.

A documented process demonstrating how the Tenderer deals with complaints. The Tenderer must be able to provide details of how their organisation maintains records of any complaints received and how corrective measures are carried out to prevent reoccurrence.

Health and Safety Procedures.

The Tenderer must hold a UKAS (or equivalent) accredited independent third party certificate of compliance in accordance with BS ISO 45001 (or equivalent) or have, within the last 12 months, successfully met the assessment requirements of a construction-related scheme in registered membership of the Safety Schemes in Procurement (SSIP) forum.

OR,

The Tenderer must have a regularly reviewed and documented policy for Health and Safety (H&S) management, endorsed by the Chief Executive Officer, or equivalent. The policy must be relevant to the nature and scale of the work and set out responsibilities for H&S management at all levels within the organisation. The policy must be relevant to the nature and scale of your operations and set out your company’s responsibilities of health and safety management and compliance with legislation. Note - Organisations with fewer than five employees are not required by law to have a documented policy statement.

Environmental Management Systems or Standards.

The Tenderer must hold a UKAS (or equivalent) accredited independent third party certificate of compliance with BS EN ISO 14001 (or equivalent) or a valid EMAS (or equivalent) certificate,

OR

The Tenderer must have the following:

A regularly reviewed documented policy regarding environmental management, authorised by the Chief Executive, or equivalent. This policy must include and describe the Tenderer’s environmental emergency response procedures, including the preparedness and response procedures for potential accidents and emergency response situations that give rise to significant environmental impacts (for example hazardous substances spill control).

Procedures for dealing with waste (e.g. waste management plans, waste segregation, recycling etc.).

Scotland Excel will require the members of any tendering group of entities (including but not limited to consortium members, members of a group of economic operators and/or sub-contractors) to be jointly and severally liable for the performance of the contract (no matter the legal form taken by those entities in order to enter into the contract).

V1.2 Information about electronic workflows

Bidders are advised whether electronic ordering, invoicing and payment will be used or accepted is at the discretion of each Scotland Excel Local Authority Member or Associate Member which will be settled by them during the procedure for the call off of a contract under this proposed framework agreement.

In accordance with Regulation 72 of the Public Contracts (Scotland) Regulations 2015, the Contract may be modified without a new procurement procedure in certain circumstances. For further information see “20-18 Regulation 72” document in the “Information and Instructions” folder and the applicable Terms and Conditions of contract.

Variant offers will be considered at Scotland Excel’s discretion where the offer complies with the conditions for participation referred to herein at III.1.

Scotland Excel will hold a Tenderer Information Session which interested parties may attend. The purpose of these sessions will be, in summary, to provide:

- an introduction to the use of the electronic tendering system;

- a description of the scope of this procurement process;

- a description of the procurement process to be undertaken by Scotland Excel;

- an overview of the structure of the tender documents; and

- allow interested parties to ask further questions on any of these matters.

The Session will take place on Tuesday 26th March 2019.
