II.2.4) Description of the procurement

The scope of the requirement is to provide a full Facilities Management service to the Scottish Courts and Tribunals Service (SCTS). The estates of Crown Office and Procurator Fiscal Service (COPFS)will be also included in the contract.

Section III: Legal, economic, financial and technical information

III.1) Conditions for participation

III.1.2) Economic and financial standing

List and brief description of selection criteria:

In respect of section 4B of the ESPD

- Question 4B.1.4 bidders should provide their average yearly turnover for the previous three financial years (insofar as not clear within the audited accounts)

- Question 4B.4 bidders will be required to state the following financial ratios and it is a minimum requirement that the ratios are within the acceptable range:

o Current Ratio of the Company (liquidity ratio) - Acceptable Range is from 1-2

o Net Profit Margin of the Company (net profits divided by revenue x100) Acceptable Range is >0 (i.e. positive)

o Debtors’ days – Acceptable range is a maximum of 40 days

- Question 4B.5 It is a requirement of this contract that bidders hold, or can commit to obtain prior to the commencement of any contract awarded subsequently, the types and levels of insurance indicated below:

Employer’s Liability Insurance = GBP 10Million

Public Liability Insurance = GBP 10 Million

Professional Indemnity = GBP 5 Million

- Question 4B.6 bidders shall include copies of the audited accounts for the most recent three years and shall provide details of any significant differences since the last set of audited accounts.

III.1.3) Technical and professional ability

List and brief description of selection criteria:

Bidders should answer the following questions in section 4C of the ESPD which shall be scored in accordance with the weighting and scoring mechanism set out in part II.2.9 of the OJEU Notice:

- Question 4C.1.2.1b bidders shall provide examples that demonstrate that they have the relevant experience to deliver the services set out in the notice.

- Question 4C.2 bidders shall provide a statement of the relevant professional and technical skills available in relation to this procurement exercise.

- Question 4C.7 bidders shall confirm that the environmental management measures that it employs in relation to contracts of this nature.

Bidders require to answer the following questions in sections 4C and 4D of the ESPD as follows:-

- Question 4C.8.8a bidders shall confirm their average annual manpower for the last three years

- Question 4C.8.8b bidders shall confirm the number of managerial staff for the last three years

- Question 4C.10.10 bidders shall confirm the proportion (i.e. percentage) of the contract that you intend to sub-contract

- Question 4D.1 bidders must either (i) hold a UKAS (or equivalent) accredited independent third party certificate of compliance in accordance with BS EN ISO 9001 (or equivalent) or (ii) have a documented quality management plan/policy which complies with the provisions set out in Appendix 3.

- Question 4D.2.1 bidders must either (i) hold a UKAS (or equivalent) accredited independent third party certificate of compliance with BS EN ISO 140001 (or equivalent) or a valid EMAS (or equivalent) certificate or (ii) have a documented environmental management plan/policy which complies with the provisions set out in Appendix 3.

Questions 4C.1.2.1b, Question 4C.2 and Question 4C.7 shall be marked 0-4 in accordance with the following marking scheme:

Score=0, Unacceptable, Nil or inadequate response. Fails to demonstrate an ability to meet the requirement;

Score=1, Poor, Response is partially relevant and poor. The response addresses some elements of the requirement but contains insufficient/limited detail or explanation to demonstrate how the requirement will be fulfilled;

Score=2, Acceptable, Response is relevant and acceptable. The response addresses a broad understanding of the requirement but may lack details on how the requirement will be fulfilled in certain areas;

Score=3, Good, Response is relevant and good. The response is sufficiently detailed to demonstrate a good understanding and provides details on how the requirements will be fulfilled;

Score=4, Excellent, Response is completely relevant and excellent overall. The response is comprehensive, unambiguous and demonstrates a thorough understanding of the requirement and provides details of how the requirement will be met in full.

The weighting to be applied to each question is as follows:-

- Question 4C.1.2.1b 35%.

- Question 4C.2 30%.

- Question 4C.7 35%.

The minimum requirement for a Quality Management Plan/Policy and Environmental Management Plan/Policy when certificates are not available please refer to Appendix 3:Quality Assurance Schemes and Environmental Management Standards.

VI.3) Additional information

Only the successful contractor will require and be responsible for the completion of the Baseline Personnel Security Standard Application Form for Non-Government Staff. Evidence of vetting to this standard of all the contractor’s staff to be used in the provision of the facility management services must be provided to the Authority before the contract commencement date. The costs for obtaining all the necessary vetting certificates will be borne by the successful contractor. The Authority accepts no liability for costs incurred in the process of obtaining such clearance certification. The contractor shall ensure the currency of the facility management employee’s vetting certificates for the period of the contract.

Statement on Community Benefit: the nature of the contract will provide the successful bidder opportunities to subcontract to small and medium sized enterprises.

Note: Where the audited account (question 4B.4.4) is not available, please provide one or more of following in respect of your organisation or guarantor (as the case may be):

i. a statement of your turnover, profit and loss account and cash flow for the most recent year of trading; and/or

ii. a statement of your cash flow forecast for the current year and a bank letter outlining the current cash and credit position; and/or

iii. an alternative means of demonstrating financial status if trading for less than a year.
