Abstract: The intent of the competition is to appoint a suitably qualified and experienced organisation to undertake design consultancy services in relation to the delivery of the A96 Dualling Inverness to Nairn (including Nairn Bypass) scheme.
The scope of the services will include but not be limited to undertaking a Design Manual for Roads and Bridges (DMRB) Stage 3 assessment of the preferred option which will be announced in October 2014, development of specimen design, statutory procedures, preparation of tender and contract documentation, and construction supervision. Throughout the commission the organisation shall undertake the duties of the CDM Co-ordinator in accordance with the Construction (Design and Management) Regulations 2007 as amended or updated.
Transport Scotland may also require additional similar design consultancy services associated with the outcome of the A9/A96 Connections Study which is currently being progressed.

Short description of the contract or purchase(s)

The intent of the competition is to appoint a suitably qualified and experienced organisation to undertake design consultancy services in relation to the delivery of the A96 Dualling Inverness to Nairn (including Nairn Bypass) scheme.

III.1)

Conditions Relating to the Contract

III.1.1)

Deposits and guarantees required

A Parent Company Guarantee may be required from the parent company (or companies) of Single Economic Operators and from the parent company of each member of a Group of Economic Operators. Details shall be provided in the tender documents in respect of deposits and guarantees.

III.1.2)

Main Terms of financing and payment and/or reference to the relevant provisions

The payment terms will be made against a schedule of rates and prices. Further details of the remuneration and payment terms shall be provided in the tender documents.

III.1.3)

Legal form to be taken by the grouping of suppliers, contractors or service providers to whom the contract is to be awarded

If the successful participant is a consortium, the Scottish Ministers shall require each consortium member to be jointly and severally liable pursuant to the terms of the Contract. The Scottish Ministers may require the consortium to form a legal entity before entering into the Contract.

III.2)

Conditions for Participation

III.2.1)

Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers


Economic operators will be evaluated in accordance with the Public Contracts (Scotland) Regulations 2012, as amended, on the basis of information provided in response to a Prequalification Questionnaire (“PQQ”), which forms part of the Prequalification Document (Refer to VI.3).

III.2.2)

Economic and financial capacity


Conditions are as set out in the Prequalification Prospectus and Questionnaire.



Economic operators shall be required to satisfy minimum standards of economic and financial standing. These minimum standards are described in detail in the Prequalification Prospectus and Questionnaire. The financial information received as part of each PQQ Submission shall be evaluated and scored out of 40 against four weighted categories: financial structure; operating performance; investment; and, financial position. Each category has a weighting of 10. A PQQ Submission shall be marked as a FAIL and shall not be considered further if the weighted score is less than fifty percent in respect of any of the four economic and financial criteria evaluation categories.


III.2.3)

Technical capacity


Conditions are as set out in the Prequalification Prospectus and Questionnaire.



Economic operators shall be required to satisfy minimum standards of technical capacity or professional ability. These minimum levels are described in detail in the Prequalification Prospectus and Questionnaire and can be summarised as:

(a) Have generated a fee turnover, relating to civil engineering infrastructure projects, of at least 100 million GBP in three of the last 5 years.

(b) Have current professional indemnity insurance to the value of at least 10 million GBP in respect of each and every claim in the period of the insurance and, subject to any other provision of the Contract, shall be unlimited in all other respects unless agreed otherwise in writing by the Employer.

(c) Have provided project management services in relation to road infrastructure projects each with a project construction cost of at least 100 million GBP, exclusive of VAT within the last 8 years.

(d) Have provided road infrastructure design services in relation to road infrastructure projects each with a project construction cost of at least 100 million GBP, exclusive of VAT within the last 8 years.

(e) Have prepared statutory processes in relation to road infrastructure projects each with a project construction cost of at least 100 million GBP, exclusive of VAT within the last 8 years; and

(f) Have provided construction supervision services in relation to road infrastructure projects each with a project construction cost of at least 50 million GBP, exclusive of VAT, within the last 10 years.

Objective criteria for choosing the limited number of candidates

As described in detail in the Prequalification Prospectus and Questionnaire.

The Scottish Ministers intend to invite 5 economic operators to tender. These economic operators shall be those 5 economic operators who have:

(a) submitted a compliant PQQ Submission;

(b) gained a PASS in respect of the financial evaluation conducted pursuant to the Prequalification Prospectus;

(c) gained a PASS in respect of the eligibility and minimum standards of technical or professional ability evaluation conducted pursuant to the Prequalification Prospectus;

(d) gained a PASS in respect of Section 4 of the PQQ;

(e) scored 50 percent or more of the available maximum weighted evaluation score for each question in Section 6 of the PQQ; and

(f) achieved the first, second, third, fourth, or fifth highest combined weighted scores in respect of technical or professional ability calculated in accordance with the Prequalification Prospectus,

may be selected as the Tenderers.

If an economic operator has not submitted a compliant PQQ Submission as described in (a) above, failed in respect of either (b), (c) or (d) above or has not scored 50 per cent or more of the available maximum weighted score for each question in Section 6 of the PQQ, as described in (e) above, then that economic operator shall be excluded from the ranking of scores described in (f) above.

Additional Information

Transport Scotland will conduct the proposed procurement process for the A96 Dualling Inverness to Nairn (including Nairn Bypass) Multi-Disciplinary Support Services Contract on behalf of the Scottish Ministers. In the event of the conclusion of the Contract, the A96 Dualling Inverness to Nairn (including Nairn Bypass) Multi-Disciplinary Support Services Contract will be entered into between the Scottish Ministers and the successful tenderer.

Any economic operators wishing to participate in response to this notice can download the Prequalification Document, which consists of Prequalification Prospectus and Prequalification Questionnaire, from the Buyer Profile address given within Section I.1. Alternatively, the Prequalification Document can be obtained from Transport Scotland at the address given in I.1 of this notice.

PQQ submissions should be delivered to Transport Scotland at the address identified in Annex A.III, by no later than 12:00 noon BST on 25.09.2014. The Scottish Ministers shall not evaluate any PQQ submissions received after the specified deadline, unless the delay is caused by a situation out with the control of the economic operator, the determination of which shall be at the sole discretion of the Scottish Ministers. Compliance with achieving the specified deadline is the sole responsibility of the economic operator (including obtaining evidence of receipt by Transport Scotland on behalf of the Scottish Ministers).

Economic operators who alter their composition after making a PQQ Submission will require to be subject to re-evaluation.

The Scottish Ministers reserve the right not to award any Contract as a result of the procurement process initiated by this notice and to make whatever changes the Scottish Ministers deem appropriate to the content, process, timing and structure of the procurement process.

Transport Scotland and the Scottish Ministers shall have no liability for any costs howsoever incurred by those participating in the prequalification procedure and if an economic operator is selected to submit a tender Transport Scotland and the Scottish Ministers shall have no liability for any costs howsoever incurred by those participating in the tender process.

Economic operators should be aware that requirements to promote health and safety in the United Kingdom (UK) came into effect on 06 April 2007 in the form of Construction (Design and Management) Regulations 2007. These regulations enact EC Directive 92/57/EEC dated June 1992 in UK domestic legislation.

It is the intention that the successful tenderer will in accordance with the Construction (Design and Management) Regulations 2007:

(a) appoint suitably competent individuals from within the organisation, as Designers; and

(b) appoint suitably competent individuals from within the organisation, to discharge the duties of the CDM Co-ordinator on behalf of the organisation.

Economic operators should be aware that all information submitted to the Scottish Ministers may need to be disclosed and/or published by the Scottish Ministers in compliance with the Freedom of Information (Scotland) Act 2002 and the Environmental Information (Scotland) Regulations 2004.

Information given in II.2.1 of this notice is preliminary.

The date referred to in IV.3.5 of this notice is provisional.
