The City of Edinburgh Council is seeking to purchase a Bus Lane Camera Enforcement System (and possibly related services) through a single supplier contract. The system will consist of five cameras and a core offence viewing processing system. The City of Edinburgh Council is seeking to purchase a Bus Lane Camera Enforcement System and possibly related services. Tenders will be invited for the following four options:

Option 1 - Provision of System (14 week contract)

Option 2 - Provision of System & Maintenance Service (14 week + 3 year contract)

Option 3 - Provision of System & Management & Operation Service (14 week + 3 year contract)

Option 4 - Provision of System, Maintenance Service & Management & Operation Service (14 week + 3 year contract)

Tenderers are required to bid for all options. The Council intend to award this contract to a single supplier who will deliver the option selected by the Council.

1. It is a mandatory requirement of this contract that the Contractor and any proposed sub-contractor has the appropriate insurance as fully detailed within the Terms & Conditions of Contract.

2. It is a mandatory requirement of this contract that the Contractor or their proposed sub-contractor provide a system with the required Type Approval for use in the civil enforcement of bus lane regulations.

3. It is a mandatory requirement of this contract that the Contractor has a robust and relevant Health and Safety Policy.

4. It is a mandatory requirement of this contract that the Contractor has a robust and relevant Environmental Policy.

5. It is a mandatory requirement of this contract that the Contractor has a proven track record and the relevant expertise required to deliver this contract.

6. It is a mandatory requirement of this contract that the Contractor has the capacity to deliver this contract (i.e. human resources, plant, technical equipment, sites and facilities).

Conditions for Participation

III.2.1)

Personal situation of economic operators, including requirements relating to enrolment on professional or trade registers


(1) All candidates will be required to produce a certificate or declaration demonstrating that they are not bankrupt or the subject of an administration order, are not being wound-up, have not granted a trust deed, are not the subject of a petition presented for sequestration of their estate, have not had a receiver, manager or administrator appointed and are not otherwise apparently insolvent.

(2) All candidates will be required to produce a certificate or declaration demonstrating that the candidate, their directors, or any other person who has powers of representation, decision or control of the candidate has not been convicted of conspiracy, corruption, bribery, or money laundering. Failure to provide such a declaration will result in the candidate being declared ineligible and they will not be selected to participate in this procurement process.

(3) All candidates will be required to produce a certificate or declaration demonstrating that they have not been convicted of a criminal offence relating to the conduct of their business or profession.

(4) All candidates will be required to produce a certificate or declaration demonstrating that they have not committed an act of grave misconduct in the course of their business or profession.

(5) All candidates must comply with the requirements of the State in which they are established, regarding registration on the professional or trade register.

(6) Any candidate found to be guilty of serious misrepresentation in providing any information required, may be declared ineligible and not selected to continue with this procurement process.

(7) All candidates will have to demonstrate that they are licensed, or a member of the relevant organisation, in the State where they are established, when the law of that State prohibits the provision of the services, described in this notice, by a person who is not so licensed or who is not a member of the relevant organisation.

(8) All candidates will be required to produce a certificate or declaration demonstrating that they have fulfilled obligations relating to the payment of social security contributions under the law of any part of the United Kingdom or of the relevant State in which the candidate is established

(9) All candidates will be required to produce a certificate or declaration demonstrating that they have fulfilled obligations relating to the payment of taxes under the law of any part of the United Kingdom or of the relevant State in which the economic operator is established.

Lodging of appeals

The City of Edinburgh Council will incorporate a minimum of 10 calendar day standstill period at the point of information on the award of the contract is communicated to tenderers. This period allows unsuccessful tenderers to seek further debriefing from the contracting authority before the contract is entered into. Applicants have 2 working days from the notification of the award decision to request additional debriefing and that information has to be provided a minimum of 3 working days before the expiry of the standstill period. Such additional information should be required from The City of Edinburgh Council, Corporate Procurement, Level 3, Waverley Court, 4 East Market Street, Edinburgh, EH8 8BG, UK. If an appeal regarding the award of contract has not been successfully resolved, the Public Contracts (Scotland) Regulations 2006 provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rule to take action in the Sheriff Court or Court of Session. Any such action must be brought promptly (generally within 3 months). Where a contract has not been entered into, the court may only award damages. (The purpose of the standstill period referred to above is to allow parties to apply to the courts to set aside the award decision before the contract is entered into).

As part of their tender submission tenderers shall provide the appropriate UMSUG code applicable to their equipment. If the tenderer is unable to provide the nessesary information by the closing date for tenders then they shall provide a commitment to provide the required UMSUG code within two weeks of award should they be successful in this tender process. Further details on UMSUG codes and the process to obtain new codes can be obtained from www.elexon.co.uk This requirement is an addendum to the Tender Document, Specification of Requirements, Section 4.1.2 and will be scored within the requirements of this paragraph.

It has been drawn to our attention that the pricing schedule contradicts the specification in that the pricing schedule requests “total costs for 3 years” where as sections 14.2.1 and 14.3.5 of the specification requests costs for 1,3 and 5 year periods. Tenderers should disregard the request for costs within the specification and only provide the costs requested within the pricing schedule.
27/01/2011 11:25Further clarification

In response to clarification questions the following response was issued "City of Edinburgh Council has no specific data regarding the expected offence levels however the cameras are expected to be operational and recording contraventions for a total of 5715 hours per annum. The tenderer is required to use their experience in this area when calculating the resources required. No target enforcement levels have been set by the Council other than that all cameras will be maintained in a state fit for continuous operation and all recorded offences shall be processed and penalty notices issued within 14 days of the offence being recorded. This time scale shall be revised at no additional cost to the Council in the event of a shorter time scale being specified by the Scottish Government". To further clarify the figure of “5715 hours” is, as assumed, the total amount of time that offences can be recorded across all the active camera sites. The sites cover a mixture of 24 hour and peak hour bus lanes, the full details of which will be provided to the contractor. In response to clarification questions the following response was issued "CEC will install any new lighting columns, where required, prior to the programmed installation date for camera equipment. Power will be provided within 10 metres of the proposed camera location as specified in 5.1.1. Tenderers are advised that due to issues with the shared use of lighting columns and additional loadings the Tenderer should assume that they will be required to install new poles to accommodate cameras at each enforcement location”. To further clarify the Council will be responsible for the provision of suitable lighting columns where these are to be used. The contractor shall be responsible for the provision and installation of any separate poles required for the mounting of cameras or equipment where lighting columns are not being used. This requirement is detailed in section 5.1.
