Abstract: Falkirk Council has been approached by Chartmount Minerals Limited to regularise the planning position at their Greenhill Opencast Coal site, Falkirk.
The Greenhill Open Cast Coal site is already the subject of two planning permissions and also the subject of an application to vary consent, which was the subject of a minded to grant consent decision.
The proposal is to simplify the planning permission at Greenhill so that the operator, the planning authority and other interested parties can understand, by reference to a single planning permission and a single planning agreement, the extent to which the proposed operation of the site for surface mining is restricted and regulated.
The objective is to provide the operator with the flexibility to work the site where a high pressure gas pipeline dissecting the site either remains in site or is moved without the need for the grant of a fresh planning application.
In order to address this matter, the operator wishes to conclude the previous minded to grant consent decision into a planning permission.
In examining these matters, Falkirk Council wishes to commission an external advisor to provide a report to:-
a) Assess whether the proposed site restoration details available at this time are sufficient to calculate the quantum of a bond to adequately provide for site restoration should the site not be satisfactorily restored by the developer.
b) In the case that there is not sufficient site restoration details to allow the quantum of a restoration bond to be calculated, detail the information which is required to allow such a bond quantum to be calculated.
c) In the case that proposed site restoration details available at this time are satisfactory for this purpose, calculate an appropriate quantum of restoration bond to ensure that the site could be restored, in accordance with proposed restoration details, should the site not be restored by the developer.
